HC asks DCs to file compliance report on shelter sheds, rentals

SRINAGAR, Feb 4: The High Court today directed Deputy Commissioners other than that of districts Ganderbal, Shoplan, Poonch and Ramban to file compliance reports with regard to Court’s previous directions on handing over the shelter sheds and rental allowances to the flood affected families of Kashmir.
In its order passed today, a division bench of the High Court comprising of Justice Muzaffar Hussain Attar and Justice Janak Raj Kotwal said that except Deputy Commissioners Ganderbal, Shoplan, Poonch and Ramban, no other Deputy Commissioner has filed compliance report as directed by the Court in its Order dated 19th December, 2014.
The directions were passed by the court after advocate G.A Lone filed an application inviting court’s attention towards what he said unknown distribution of central government’s monetary compensation in favour of flood affected families.
On December 19, 2014, the High Court had asked the state government to provide shelter sheds and rental allowances to the flood hit homeless families by the end of December 2014.
In pursuance to this order Ghulam Hassan Malik, Technical Officer to Chief Engineer PW (RAR) Department Kashmir filed status report which says that the department has constructed 285 shelter sheds. The possession of these shelter sheds, complete in all respects, has been handed over to the concerned Deputy Commissioners, the compliance report filed by the department informed.
The court said that it is not known as to whether the possession of the shelter sheds has been handed over by these Deputy Commissioners to the affected families. “It is also not known as to where the affected families, who have not opted for shelter sheds, have been paid the rent. The Deputy Commissioners other than the aforesaid Deputy Commissioners shall file compliance reports, indicating therein as to possession of how many shelter sheds has been handed over to the affected families and how many affected families have been paid rent,” the court ordered.
The matter along with connected matters has been listed next week for hearing. At this stage, advocate G A Lone, submitted that to his information some people lost their precious lives in the recent devastating floods while rescuing the flood affected persons.
During the hearing, M A Chashoo, additional advocate general was asked by the court to provide information to the Court whether any person has/have died as has been stated by the petitioner. “Details be provided about such persons and compensation, if any, paid to the claimants/kith and kin of such persons,” the court ordered.
On December 10, 2014 the Court had asked the state government to provide shelter sheds to the flood hit families within a week. The court had also granted one more week to the union government to file its response on details of flood victims furnished by the state government.
Previously in the same matter the Court had also reprimanded the union government for ‘misleading’ it on details of flood victims already submitted by the Jammu and Kashmir government on November 19 for availing monetary relief. The Court had asked the government of India to file an affidavit authenticating the veracity of its earlier information submitted before the court on requisite details of the flood hit families.
The court had censured state government for being ‘lax’ in rehabilitation of September flood victims. The Court had asked the state government to submit before the Government of India (GoI) a detailed list of flood victims who have suffered partial, severe and full damages to their houses.
The state government was earlier asked by the court to submit a detailed list of flood hit families who have been rendered homeless by the September floods before the union government. The detailed report was supposed to include the displaced families as well.
The Court had also granted a week to the government for filing a report on mechanism in place for regulating the distribution of relief by Non-Governmental Organizations (NGOs) among the flood victims.
On November 13, 2014 the Court had directed Divisional Commissioners of Kashmir and Jammu regions to file detailed information regarding mechanism in place for regulating the distribution of relief to the flood victims by the NGOs, individuals and companies in the state.
The court has already asked government to rehabilitate people rendered homeless by the devastating floods in September. At least 4.5 million people, over 65 percent of the total population in the Kashmir region, have been affected by the deluge and many have been left homeless.
