Court asks SSP to enquire, file detailed report

SRINAGAR, Apr 6: A city court today asked SSP Srinagar to enquire into the complaint of Hurriyat Conference (G) senior leader Ghulam Nabi Sumjhi against former Chief Minister Omar Abdullah and former SSP Ashiq Hussain Bukhari for their “role” in 2010 civilian killings and file a detailed report by or before May 5.
The court of Chief Judicial Magistrate (CJM) passed the directions after prosecution and said that SP headquarters Srinagar has been asked to enquire into the matter.
On March 17, the CJM had directed SSP Srinagar to enquire into compliant of Hurriyat Conference (G).
The court had asked the SSP Srinagar to complete the enquiry and file a detailed report in first week of April. Sumjhi through his counsel M S Reshi had pleaded before the court to treat his application under section 156 and order registration of FIR followed by investigations. However, the court had deffered issuance of processes and treated the application under section 200 as a compliant directing the SSP Srinagar to enquire the compliant under section 202 Cr.PC.
“File a detailed enquiry report on April 6,” the Chief Judicial Magistrate (CJM) Srinagar had ordered. Pertinently, a local human rights worker Mohammad Ahsaan Untoo has also filed a Public interest Litigation (PIL) in the High Court praying for criminal proceedings against Omar and Bukhari for their alleged role in the killings of innocent youth in general and 23 youths of Srinagar in 2010.
Untoo had sought indulgence of the court by treating this application as PIL and initiate a judicial process by looking in all aspects of the events of 2010 which lead to killings of innocent youth in general and 23 youths of Srinagar in particular by “use of excessive force and target killings on upper body parts of victims by State machinery.”
“The criminal proceedings be initiated against the then Chief Minister Omar Abdullah and former SSP Srinagar Ashiq Bukhari for their active role in these killings and status of trails of victims killed in 2010 as so far trail in these cases are going at snail’s pace and a not a single arrests have taken place till date as all the culprits are rooming freely as they were being shielded by state,” Untoo has prayed before the court.
In his PIL, Untoo has appealed that Judicial inquiry of role allegedly played Omar and Bakhari for their alleged involvement and conspiracy in killing of 23 innocent students of district Srinagar mostly minors in 2010 by “misusing the state machinery and power in violation of laws of the land and international laws.”
The applicant has said the victims including him have been trying to get justice for the past five years to the victims of 2010 by going pillar to post “but nobody has been brought to justice till date because of state’s continuous support to the involved persons by shielding them and by ensuring that no evidence remains against the culprits as same was a well thought conspiracy hatched by then Chief Minister of State Omar Abdullah and SSP Srinagar to kill the innocent persons for their political and personal motives by misusing state machinery and violating all laws including fundamental and human right laws.”
Untoo has alleged that the number of innocent youths in district Srinagar were killed most of them minors and police authorities declined to initiate investigations in most of the cases. “The total traced number of killed victims is 23 in whose cases nothing concrete have been done so far nor any body has been brought to justice as all of the culprits have been given promotions and other benefit by the government for the killings as same was done in connivance with the then chief minister of J&K State and SSP Srinagar,” he said.
Untoo has said that the victims as well human rights organizations have lost faith in state, in view of the recent developments wherein the then SSP has come out with revelations about the rule then of Chief Minister of J&K State, therefore, this human rights group comes before this Court with a prayer that a Judicial Commission be appointed under the aegis of High Court to initiate investigation and inquire in the culpability of Chief Minister and former SSP.
