Bureaucrats violating GAD orders with impunity in J&K

Sports Council failed to comply GAD circular on SRO-164

JAMMU, Apr 24: J&K state seems to be ruled by the bureaucrats, especially in the backdrop of accusations that the state government has exclusively handed over the baton of administration to an “influential group” of officers who are violating the General Administration Department to J&K with impunity.
Sources said, Sports Council has directed to all govt employees to immediately relinquish themselves from Sports bodies and federations till their ‘No objection’ cleared by the respective departments. Violating government order a few officers being “preferred” to stay on key positions in the Sports bodies recognised by the J&K State Sports council.
When contacted administrative officer J&K State Sports Council he said though the General Administration Department has issued strict instruction to Sports Council yet we can not take action against all those bureaucrats who are violating SRO-164, holding multiple offices in sports bodies and also violating Sports Code issued by the Council, because they are very senior to him.
Talking to ‘The Kashmir Times’ on telephone, Director General Youth Services and Sports who is also holding charge of the Secretary, J&K State Sports Council Naveen Agarwal said that we will strictly comply on order issued by the GAD. He said that there is nothing wrong in holding a post in the sports bodies, federations but as per civil service code we have to follow the orders issued by the controlling authority i.e General Administration Department to J&K govt.
Sources said that after the 49 days of the Governor rule in J&K, bureaucrats once again have made the sports council their fiefdom and manipulating the circular No:08-GAD of 2015 dated 10-02-2015 issued by the General Administration Department to J&K. They are claiming that said circular not meant for the IAS, IPS officers of the J&K cadre.
Sources in the General Administration clearly told that all the government employees including IAS, IPS have to comply said circular issued by GAD. We are not issuing any separate orders for them as all offices who have been allotted J&K cadre must comply all orders issued by the GAD.
Surprisingly , Sports Council has its autonomous status but unnecessarily hindrance of state bureaucrats in day to day affairs might raised hundreds million questions on its functioning. Ironically these officials had not played a single first class competition in either discipline. The fact is that these bureaucrats belonging to lobby ruining sports in the state. Unaware of their interest Mufti Mohammad Sayeed ‘succumb’ to their pressure and did not bother to direct the sports ministry and GAD to take action against all those bureaucrats, officials violating the Governor instruction on holding office of profit in sports bodies.
Sources said that after Mufti Mohd Sayeed took over the powers bureaucrats started playing spoil sports resulting in sportpersons are deprived of from the basic facilities. They have become regular violators of GAD orders and government did not bother to take action any action against persons violating the SRO-164, sports guidelines and illegally holding multiple offices in the sports bodies.
It seems that government is not run by the representatives elected by the people as bureaucracy ruling roost. The tall claims of the state government headed by the Mufti Mohd Sayeed about fighting corruption with tooth and nail, the officers have developed very strong network in state. This can be gauged from the status of around two dozen bureaucrats including IAS, IPS officers/ officials are violating the Chief Secretary and General Administration Department orders with impunity.
Had there been a will on the part of Government to punish the elements it would have ensured compliance of the Governor NN Vohra's directions passed for the betterment of sports . Shockingly, General Administration Department is issuing circular to all concerned departments but without any results.
However, J&K State Sports Council halfhearted approach towards all those violators holding position in the sports bodies and Federations confirmed that the Sports Council which is a state runs premier sporting body is being govern by a mafia but not by the Sports ministry or the chief minister of the J&K state.
It is worthwhile to mention here that according to a circular No:- 08-CAD of 2015 dated 10-02-21015, It has been reported that several government servants in J&K are holding office in various Sports Associations without the prior permission of the state government to hold such position, in violation of sub-rule-2 of Rule- 21 of J&K Government Employees Conduct Rules, 1971(SRO-164 dated 27- 03-1980), the relevant portion whereof reads as under:- "No Government employee shall, except with the previous permission of the Government, hold or continue to hold any office in any Sports Association of the State or the National sports Federation or Association. The application for such permission shall be made through the Secretary, Jammu and Kashmir Sports Council".
