Peerbagh Murder case": Courts records arguments on charges

SRINAGAR, Feb 18: A Budgam court has started recording arguments on charges in in Peerbagh murder case in which the body of Owais Bashir Malik, a student was found near a railway track at Humhama in January last year.
Sources in the court said the defense lawyer argued that besides medical reports there were enough circumstantial evidence to prove that the police version against the accused is factually and legally incorrect.
The court has now listed the matter for further arguments on March 3. As the matter came up for hearing before Principal District and Session’s judge Budgam, advocate Mushtaq Ahmad Dar representing Ishaan Majeed the main accused in the matter has submitted that the medical board report (post mortem report) and other circumstantial evidence is contrary to what police has said in its charges.
The Peerbagh murder case pertains to Owais Bashir Malik son of Bashir Ahmad Malik resident of Peerbagh Srinagar who went missing on January 12, 2016. His body was recovered on January 14, 2016.
It may be recalled that on January 19, 2016 the police had claimed of solving the mysterious murder of Owais. According to Deputy Inspector General of Police central Ghulam Hassan Bhat:, “On 12-01-2016, Owais Bashir Malik son of Bashir Ahmad Malik resident of Peerbagh Srinagar went missing and a missing report to this effect was entered in Police Post Humhama on January 13, 2016. In the wee hours of January 14, 2016 the body of the missing youth was recovered near Railway Bridge Humhama.
The police had said that a case FIR number 09-2016 under section 302 RPC was registered in police station Budgam. “A special investigation team (SIT) headed by Syed Fayaz Ahmad, SDPO Magam was constituted under the overall supervision of SSP Budgam to investigate the case in a time bound manner.”
During investigation, the DIG Central had said that it came to fore that for the last about one year the said Owais Bashir Malik was in contact with a person namely Eishan Majeed son of Abdul Majeed Peerzada resident of Bandipora, presently at Barzullah Srinagar.
“Eishan would pose and act like a girl by the name Umaira resident of Wanbal Nowgam and both would talk for hours together mostly during the night hours. Eishan (Umaira) would also talk at times with family members including the sisters of the Owais as also with his cousin namely Tanveer Ahmad Bhat son of Noor Mohammad Bhat resident of Galwanpora Budgam,” the police had claimed.
“Owais would press Eishan (Umaira) for a meet which was usually avoided by the later. However, on 12-01-2016, Owais pressed very hard for a meet and Eishan (Umaira) agreed to meet on the Railway Track at Peerbagh. Eishan (Umaira) divulged before the deceased that it was he who was posing as a girl. This infuriated Owais and both had a scuffle.Eishan (Umaira) got better of the Owais and brought him down on the ground over the Railway Track and also kicked him repeatedly. This injured Owais badly and he roled down into the gorge.”
The DIG had informed the press that thinking that Owais was dead, Eishan (Umaira) left for his home and subsequently to his aunt’s house at Bandipora. The two SIM cards through which he used to talk with Owais were broken by him and thrown into a Nalla and thus tried to destroy the evidence.
According to the DIG Central the investigation team had a tough time since the place where the dead body was recovered near the Railway bridge was at a distance from the place where both had a scuffle. During investigation it was found that in the evening of January 12, 2016, one constable of GRP did find some blood stains on the soil and noticed a human body in the shallow waters down the track.
“He did not inform the Police and instead planned to dispose of the body to a place away from track with his other two colleagues. The three persons of GRP namely Manzoor Ahmad resident of Chadoora, Mohammad Ayoub resident of Humhama and Noor Mohammad resident of Khansahib picked the dead body and placed it away from the track near the Railway bridge at Peerbagh,” the police had informed the press.
