VOJ lodges case against municipal officials

JAMMU, Apr 17: Vigilance Organization Jammu (VOJ) claimed to have registered a case against Chief Enforcement Officer (CEO), Assistant Enforcement Officer (AEO), and Enforcement Inspector (EI) of Jammu Municipal Corporation (JMC) and a beneficiary for construction of huge commercial building in residential area in utter violations of Master Plan and Municipal Laws.
Official report said that VOJ registered a case against Rajesh Gupta (CEO), Madan Lal (AEO), Kuldeep Kumar (EI) of JMC and beneficiary Manju Gupta wife of Vinod Mahajan.
Reports said that verification was conducted by Vigilance Organization into the allegations that on Plot number 341, situated in Bakshi Nagar, a huge commercial building is being constructed in residential area in utter violations of Master Plan and Municipal Laws. The investigation revealed that a residential building permission was issued by BOCA on April 10, 2013 vide number 49/BS/2013, in favour of Manju Gupta wife of Vinod Mahajan resident of 23/P, Extension Trikuta Nagar, Jammu with permission for build up area as ground floor, 1st Floor & 2nd Floor 1140 sq ft respectively and FAR 190, height 40 ft.
“The verification revealed that the beneficiary in active league with accused officers/officials of Jammu Municipal Corporation and in utter violation of approved plan raised the construction as ground floor, 1st Floor & 2nd Floor 1736 sq ft, FAR 95.9 and height 38 ft with setbacks 1.6 ft only. It has further revealed that in order to cover up the violations and to provide sufficient time to the beneficiary to raise said construction, a mere formality of issuing notice under section 7(1), 12(1) of Municipal Act has been undertaken,” report said, adding that the intentional inaction by the accused public servants in league with beneficiary has paved the way to beneficiary and allowed her to raise the construction in blatant disregard and violation of building permission, rules/law.
“As such, FIR has been registered at Police Station VOJ under section 5 (1) (d) r/w 5(2) J&K PC Act 2006 and Section 120-B RPC read with section 9 of COBA 1988 on the prima facie establishment of offences on the part of the then Law Enforcement wing Rajesh Gupta CEO, Madan Lal AEO, Kuldeep Kumar, EI of JMC and the beneficiary Manju Gupta,” report maintained.
