Art 35 A protects demographic status of J&K: JKPCC

JAMMU, Sep 16: Jammu and Kashmir Pradesh Congress Committee (JKPCC) Secretary Publicity Nadeem Sharief Niaz today said that special status of Jammu and Kashmir is based on matter and not in vacuum and hence can’t be abrogated. He added that through 1927 and 1932 notifications Maharaja Hari Singh imposed a law that defined state subjects and their rights.
Nadeem while addressing the meeting said, “The law also regulated migrants to the state. The reason why Maharaja enforced this law is because he had apprehensions that outsiders whose sole qualification was money could misguide tribal, poor and innocent farmers of state and would acquire their properties by exploiting or by luring them.”
He added that all the arguments against article 35 A are baseless and are raised with politically motivated intentions. He said that various Articles in the Constitution, that similarly provide special rights to other Indian states like Nagaland (Article 371A) and Mizoram (Article 371G) and notes that there are various provisions in the Indian Constitution which confer special status to several other states also, in varying degrees based on historical reasons.
He added that any attempt by anti national and right wing government to tamper with the state's autonomy is bound to result in a massive backlash and attempts to abrogate the article have been seen as an assault on the special status of Jammu and Kashmir.
He said that the myth perpetrated by right wings by advocating the abrogation of special status is that it discriminates against women. According to right wings if a woman who is a state subject in Jammu and Kashmir marries a man from outside the state, she can no longer buy land in Jammu and Kashmir. This issue was put to rest by the state’s High Court in a judgment in 2000 which clarified that a woman doesn’t lose her right to own land in Jammu and Kashmir on marrying outside the state.
Furthermore, he said that the havoc is being created to divert the attention of public from the misdeeds, mismanagement, mis-governance, delusions and incompetency of government in handling various issues including inflation, demonetization, GST and maintaining law and order.
He added that all projects in state including medical colleges, power projects of Chenab valley, roads and others have been put on hold leaving millions of local people jobless. He demanded that government should work on uniting people and not by dividing people to put veil on their mediocrity and incompetency.
