U-23 Selection: High Court issues contempt notice to Secretary YSS, JKCA

SRINAGAR, Oct 8: J&K High Court has issued a contempt notice to Secretary Youth Service Sports Department, Secretary J&K Cricket Association (JKCA) and directed Secretary JKCA to appear in person on next date of hearing.

The bench of Justice Ali Mohammad Magrey directed registrar judicial to serve the notice on Secretary J&K Cricket Association Iqbal Shah.

The directions came after the petitioner Hisham Saleem submitted that the respondents– Secretary to Government, Youth Service Sports Department and Secretary J&K Cricket Association (JKCA) Iqbal Shah have violated the court orders of October 4, 2017.

“As per the petition submitted by petitioner, he alleges violation of order passed by this court on 04.10.2017 in OWP No. 1546/2017 whereby this court on consideration of the matter, had restrained the respondents for sponsoring squad for participating in U-23 CK Naydu Trophy, till next date before the bench with further direction that the respondent N0.5 in the writ petition shall not be associated in making selection of the team for U-23,” the court said.

The court added that petitioner has submitted that copy of order dated 4.10.2017 was served on the respondent- Jammu & Kashmir Cricket Association, however, receipt of the same was declined, leaving no option for the petitioner but to affix another copy of the order on the notice board of the respondent-office and also having sent a copy via facsimile and also via internet messenger. It is alleged that despite aforesaid order passed by this court, the respondents having gained full knowledge about the order, have instead of implementing the order, processed and finalized the selection and are in process of sending the selected team for playing the tournament.

It is also alleged that respondent Secretary J&K Cricket Association Iqbal Shah has telephonically communicated the players, selected after court order, secretly and asked them to assemble in a Hotel at Rajbagh wherefrom they are to be taken to the Airport, court further added.

“Prima facie a case for the contempt of court is made out. Notice waived by Rais ud Din Ganai, GA, for respondent Secretary to Government Youth Services and Sports Department. Notice shall be served on Secretary J&K Cricket Association Iqbal Shah,” the court said.
