CJM directs SHO PS Trikuta Nagar to register FIR

JAMMU, Oct 2 (JNF): In an application filed by Rumpy Madaan Chairman SAVE seeking registration of FIR against the person who slauther camel at Bathindi, CJM Jammu Ashwani Sharma after hearing Ravinder Sharma and Aditya Vikram Sharma, directed SHO Police Station Trikuta Nagar to register the FIR under relevant provisions of law and investigate the matter.”
Rumpy Madaan, the Honorary Animal Welfare Officer of Animal Welfare Board of India, Ministry of Environment, Forest and Climate Change, Govt. of India, filed a complaint under Section 156 (3) of the Criminal Procedure Code for seeking direction to the SHO Police Station Trikuta Nagar, Jammu for registration of criminal case against the accused persons.
In her complaint she alleged that on 23rd August, 2018 in full public view, illegally, camels were slaughtered in Bathindi area near Macca Masjid for its meat which is not permissible under the Food Safety and Standard Authority of India Act.
The video of slaughtering of the camels was recorded and made viral on the social media. The said video clearly shows the gathering of the public including children in which the animal was killed in a most brutal manner.
It is worthwhile to mention that slaughtering of animal of any other species other than the permissible by the Food Safety and Standard Authority of India, is illegal and camel meat does not come under the purview of the “Animals” as defined in the Regulation. More so, slaughtering of any animal in full public view in a cruel manner BY inflicting unnecessary pain and sufferings to the animals is an offence under the Prevention of Cruelty to Animals Act.
The complainant desperately made repeated calls to Police Control Room for its help to prevent the illegal slaughtering of the camels but there was no response from the PCR.
The complainant filed a written complaint to SHO Police Station Trikuta Nagar, Jammu on 24/08/2018 alongwith video footage urging upon him to take immediate action against the accused persons.
The complainant also approached to Inspector General of Police, Jammu and submitted one copy of the complaint. The IGP forwarded the complaint to SSP, Jammu directing him to look into the complaint and deal under law.
It is sad state of affairs and inaction at the part of the police that despite direction is being given by the IGP, Jammu to SSP, Jammu, the Police neither registered FIR nor arrested the accused persons.
It was also urged in the complaint that one lame person bearing scull-cap, appearing in the picture is the person who abetted the people to commit the offence and on his instigation the persons appearing in the picture having dagger in their hand have slit the throats of the camels, therefore, the above said accused persons are liable to be punished under section 109 and 114 of the Ranbir Penal Code. The accused persons are also liable to be punished under section 429 of the Ranbir Penal Code for committing offence of mischief by killing camels, mercilessly in full public view.
The accused persons have committed offence under sections 109, 114 & 429 of the Ranbir Penal Code, 36 of Police Act and Prevention of Cruelty to Animals Act, as such, a criminal case is required to be registered against them and the accused persons are liable to be tried, prosecuted and punished in accordance with law.
CJM Jammu Ashwani Sharma after hearing Advocates Ravinder Sharma and Aditya Vikram Sharma in length observed that a perusal of the application transpires that the commission of cognizable offence is disclosed against the accused. The applicant had also availed the remedy U/S 154 (1) Cr.P.C. and 154(3) Cr.P.C. The application is duly supported with an affidavit. Accordingly,
Incharge/SHO Police Station Trikuta Nagar, Jammu is directed to register the FIR under relevant provisions of law and investigate the matter.”
