Main accused get life term, Rs 5 lakh compensation to victim’s mother

SRINAGAR, Oct 21: Court of Principal District and Sessions (PDS&J) Srinagar today awarded life imprisonment for main accused in the hit and run case claiming life of a teenage girl Romana Javed at Sanatnagar locality in Srinagar in 2009.
Besides rigorous imprisonment to the main accused of the case, Shoaib Darial, the court has announced Rs five lakh compensation to the mother of the deceased. The amount will be paid by the State Legal Services Authority (SLSA) on behalf of the accused.
The verdict comes ten years after the incident which claimed life of a teenage girl student Romana Javed outside her tuition centre at Sanatnagar locality on May 3, 2009.
The incident sparked massive protests by the family of the deceased and people from every walk of life including students to seek sternest punishment for both of the accused.
The accused was represented by Advocate Mushtaq Ahmad Dar and the prosecution was led by the Public Prosecutor, Abdul Aziz Teli who vehemently opposed defense counsel’s assertions that the accused was falsely implicated by the family of victim.
Court while rejecting defense counsel’s plea observed that in view of convincing and clinching evidence led by the prosecution, the inevitable conclusion is that prosecution has proved charges against the accused beyond any reasonable doubt while awarding life sentence to the accused under Section 302 RPC.
“Therefore, in this backdrop, the prosecution has proved beyond reasonable doubt that the accused used the vehicle as a weapon of offence and hit the deceased with all force and intention to kill her. The accused tried to run over her but the hit of the vehicle was so powerful that the deceased blew up and fell down on the ground,” reads the order passed by Principal District and Sessions Court, Abdul Rashid Malik.
Order further read that the vital injuries inflicted on the head and other parts of the body of the deceased proved by the doctor demonstrated that the accused had no other intention except to kill the deceased to take revenge from her for not responding to his request on the chit to talk to him on his cell phone. “Therefore, the commission of offence under Sections 302 is proved beyond any shadow of doubt”
The court directed that State Legal Services Authority shall pay an amount of Rs. 5.00 lacs to the mother of the victim, who at the time of the death of her daughter only saw that the deceased was moving her lips and one can imagine the pain and agony which was caused to her due to the death of her daughter.
The other accused Obaid Ahmad who was released on bail being juvenile undergoes trial at Juvenile Justice Court. Public Prosecutor, Abdul Aziz Teli while talking to ‘Kashmir Times’ said he will seek equal punishment for Obaid under new law of the constitution.
“According to recent judgment of the Supreme Court of India, only 16 years old can be treated as juvenile. He (Obaid) undergoes trail at Juvenile Justice Court at present, under amended we can challenge same,” added he.
