Woman, 2 others acquitted by court in 35-year-old murder case

SRINAGAR, Nov 19: A local court in north Kashmir district of Baramulla acquitted three persons, including a woman, in a 35-year-old murder case following lack of credible evidence.
An official spokesperson on Tuesday said that in a landmark judgement towards streamlining criminal justice system, principal district sessions judge Baramulla Sanjeev Gupta on Monday settled a 35-year-old murder case by acquitting three accused for lack of credible evidence.
“As per prosecution case, one Habibullah Bhat went missing on the intervening night of November 6 and November 7, 1986 from his house situated at village Watapora in Bandipora,” he said, adding his decomposed and mutilated body was recovered in a gunny bag near a house in the village about a month later.
However, he said during the course of investigation, the involvement of three persons residing in the neighbourhood of the deceased surfaced. “It was alleged during the investigation that deceased was having extra-marital relations with one of the accused who along with her husband and brother hatched a conspiracy which led to the brutal death of the deceased,” he said.
After hearing the Public Prosecutor appearing on behalf of the state and counsel for the accused, the Principal District Sessions Judge held that as per evidence tendered in the case, the prosecution was not able to prove the motive behind the murder of deceased by the accused.
The Judge, who is also holding the additional charge of court of Additional District Sessions Judge Baramulla before which the case was pending for over 30 years, held that the recoveries made at the instance were also held to be planted in order to frame the accused in the crime.
Justice Gupta, while giving benefit of doubt to the trio, observed that prosecution was not able to prove its case beyond a reasonable doubt and acquitted them of the charge of murder.
