Govt warns action on Sports bodies/ NGOs involved in violating DoPT’s order

Family rules in sports bodies /Federations to end: IOA president

JAMMU, Feb 24: The president Indian Olympic Association Dr Narinder Dhruv Batra has directed all the sports associations of J&K included J&K Olympic Association not to violate the government order No: F.No. 11013/1/2016-Estt-A-III issued by Govt of India, Ministry of Personnel, Public Grievances & Pension, Deptt of Personnel & Training Dated 5th August, 2019 and elect office bearers to govt employees for more than one term and provide them membership unless they would seek prior permission from J&K Govt to become member of sports bodies/Federation.
President Indian Olympic Association assured the members of various recognized J&K Sports Associations in J&K on February 23rd, 2020 that all the left out Olympic sports associations will be included in the JKOA member list for the forthcoming election of JKOA.
Batra said that soon a code will enforce where family rule in Sports Federations and Associations will get over and only deserving candidates will get opportunity to run Sports Associations in professional manner , where if a person has held some Principal Office bearer post in an association, after his term expires, his family member immediately cannot take up Principal Office bearer post, which is happening every now and then.
Dr SM Bali, Joint Secretary, IOA also pointed our irregularities in JKOA . He said that JKOA has become fiefdom of a person and the said person is not holding elections its in free and fair manners for the last 43rd years.
Batra said that IOA, JKOA and State Sports Associations are bound to obey the recently order issued by Ministry of Personnel, Public Grievances & Pensions, Deptt of Personnel and Training. However, all those sports bodies do not adhere to govt norms will face action.
He told that Indian Olympic Association has appointed Chander Mukhi Sharma, Secretary-General of the Basketball Federation of India, as the observer for the Jammu and Kashmir Olympic Association elections. I am waiting for his report , he told.
The order reads as that as per rule 15(1) (c) of the CCS (Conduct) rule, 1964, no Government servant shall expect with the previous sanction of Government, hold an elective office, or canvass for a candidate or candidates for an elective office , in any sbody, whether incorporated or not . DoPT’sOM No 11013/9/93-Estt (A) dated 22-04-1994 had also stipulated that no govt servant should be allowed to hold elective office in any sports association/ Federation for more than 4 years, or for one term which ever in less.
Further , according to DoPT’s OM No 11013/11/2007-Estt (A) dated 13th November 2007, the entire time of Government Servant should be available to government and that no activities unconnected with his or her official duties should be allowed to interfere with the efficient discharge of such duties. All the ministries were directed to ensure that the participation of the government servants in the activities of the cooperative societies conform to the above provisions and does not interfere with the discharge of their official duties, the order aid.
It further stated that “Instances have come to notice of IOA that several Govt employees of J&K continue to hold elective offices in various capacities for unduly long periods. In most of cases where bye laws of the sports bodies place restrictions on the number of consecutive terms a person may hold an office, Govt servants are reported to have either got themselves re-elected after a gap or have got a family members/close relative elected as surrogate in order to keep control of such bodies. In such cases, Government servants may not be bestowing adequate attention upon their official duties and as a result, an apprehension may arise that such Government servants also develop vested interests, particularly if the body is involved in commercial activities, directly or indirectly”.
The order clearly said that Government servants can hold elective office in any body in their entire career for period of two terms or period of 4 years, which ever is earlier, for which prior sanction is required, earlier sanctions are reviewed and permissions earlier granted revoked where Government Servant have holding office in any sports body.
